Templafy is committed to protecting your privacy. We provide this Privacy Policy to explain the type of information we collect and how that information is used. This Privacy Policy applies to personal data collected through Templafy’s cloud-based content enablement solutions (“Templafy Solutions”), during visits to our website and offices, during attendance at events hosted by us, or when you interact with us via a different channel.  

By “us”, “we”, and “Templafy”, we refer to Templafy ApS and any other affiliates of Templafy.

In this Privacy Policy, “personal data” means information that identifies you as an individual. How we handle your personal data depends on which Templafy services you use and how you use them. The legal bases in the below table are a reference to the GDPR Article 6.

We do not sell or share your personal data to third parties for their marketing purposes. However, we share your personal data with other parties that may assist us in providing our services, as described in the above table, and further elaborated in this section. We maintain processes designed to ensure that any processing of personal data by third parties is consistent with this Privacy Policy and protects the confidentiality, integrity and availability of your personal data

We may provide your personal data to companies that provide services to help us with our business activities. These companies are authorized to use your personal data only as necessary to provide these services to us, in compliance with this Privacy Policy and appropriate data processing terms signed with them. Third-party service providers are thoroughly vetted in terms of their ability to live up to Templafy’s requirements for information security and data protection measures.

We may disclose your personal data to a third party if we reasonably believe that disclosure is compelled by applicable law, regulation, legal process, or a government request, or to protect the security or integrity of our services, or to protect ourselves, or our customers or users of our website. Unless we are prohibited by law, we will notify you of any disclosure requirement. 

In case Templafy is involved in a merger, sale, consolidation, change in control, transfer of substantial assets, reorganization or liquidation, your personal data and other information concerning your relationship with us might be disclosed, under conditions of confidentiality, to our advisers and any prospective purchaser’s advisers. In this case we will inform you, via email and/or a prominent notice on our website, of any change in ownership and use of your personal data.

We may also disclose your personal data to any other third party with your prior consent, or after having de-identified or aggregated your personal data in a way that they cannot be used to identify you anymore.  

The personal data collected by us will not be kept for longer than is necessary to fulfil the purposes mentioned above. When we have no ongoing legitimate business reason nor legal obligation to process your personal data, we will delete, anonymize, or securely store it and isolate it from any further processing until deletion is possible.

We have implemented best practice standards of technical and operational security to protect personal data from loss, misuse, alteration, or destruction. Only authorized personnel of Templafy and of our third-party service providers are provided access to personal data, and these employees and third-party service providers are required to treat this information as confidential. Templafy welcomes innovative technology and methods to improve our services and optimize our business while practicing caution and maintaining a security-first approach in everything we do. Artificial Intelligence (AI) used by Templafy and its service providers is subject to existing stringent security and privacy standards to protect the data with which we have been entrusted. Before authorizing third-party or internal use of AI, we ensure to thoroughly vet the learning capabilities of the machine learning models, assess any increased risks to the rights and freedoms of data subjects, and ensure compliance with the data protection level outlined in any applicable contracts, this policy, and the applicable legislation. Where applicable, customer administrators are given the opportunity to control the degree to which AI functionality is a part of the Templafy Solutions delivered and end users can choose whether to interact with this functionality. As applicable by the data protection legislation in your jurisdiction, you may have the ability to exercise your rights to privacy as explained below:

  • Right to access your personal data that Templafy holds
  • Right to rectification of inaccurate personal data about yourself
  • Right to erasure of your personal data, in particular if you withdraw your consent or the data is no longer necessary for the purposes for which it was collected
  • Right to restrict processing, for instance if you wish to contest the accuracy of your data or object to processing based on legitimate interest
  • Right to data portability, i.e., to obtain and reuse your personal data for your own purposes across different services
  • Right to object, e.g., processing based on legitimate interest and direct marketing
  • Rights related to automated decision making and profiling
  • Right to withdraw consent previously given
  • Right to lodge a complaint with a supervisory authority in your EU Member State of residence
  • Right to withdraw from any financial incentive offered by Templafy in exchange of your personal data, e.g., when you participate in surveys

Please note that we may be acting as a data processor on behalf of our customers when delivering services to these customers. If you are an end user of Templafy Solutions and wish to exercise your rights regarding the personal data about you within Templafy Solutions, please refer to the administrator of your organization.

Templafy makes use of cookies to understand and save your preferences for future visits to our websites, compile aggregate data about site traffic and interactions, and improve site experiences and solutions. Templafy has implemented measures to promptly handle your privacy requests. To help protect your privacy and security, we might take reasonable steps to verify your identity before granting you access to your personal data. We will make reasonable attempts to promptly investigate, comply with, or otherwise respond to your requests as may be required by applicable law.

Depending upon the circumstances and the request, we may not be permitted to provide access to personal data or otherwise fully comply with your request; for example, where producing your information may reveal the identity of someone else. We might refuse your requests where, at Templafy’s discretion, they may be unfounded, excessive, or otherwise unacceptable under applicable law. 

Your personal data may be transferred to and processed in countries other than the country where it was initially collected, where Templafy operates, or where our partners or third-party service providers operate. Some of these countries might have different and less protective rules than those of your country. As a result, we take measures to ensure that your personal data is safe and protected in compliance with applicable data protection laws. 

Templafy complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Templafy has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Templafy has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Templafy is responsible for the processing of personal data it receives under EU-US DPF, the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, and subsequent transfers to a third-party acting as an agent on its behalf. With respect to personal data received or transferred pursuant to the EU-U.S. DPF and the Swiss-U.S. DPF, Templafy is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Templafy may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Templafy commits to resolve DPF Principles-related complaints about our collection and use of your personal information. EU and UK and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF (and the Swiss-U.S. DPF) should first contact Templafy, using the contact information at the top of this Privacy Policy. In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Templafy commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs), the UK Information Commissioner’s Office (ICO), the Gibraltar Regulatory Authority (GRA), the Swiss Federal Data Protection, and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF. An individual has the possibility, under certain conditions, to invoke binding arbitration for complaints regarding DPF compliance not resolved by any of the other DPF mechanisms. We do not knowingly collect or solicit information from anyone under the age of 13. If you are under 13 years old, please do not attempt to register for any Templafy services or send any personal data about yourself to us. If we learn that we have collected personal data from a child under 13 years old, we will delete that information to the extent required by applicable laws. If you believe that a child under 13 years old may have provided us with their personal data, please contact us at privacy@templafy.com.

At our discretion, we may include hyperlinks on our websites that link to third-party websites. These websites have separate and independent privacy policies. Our Privacy Policy does not cover any linked sites, and we are not responsible for the privacy practices of these sites or any companies we do not own or control. Templafy does not endorse any products, services or other content described or offered on any linked sites. We encourage you to seek out the privacy policies applicable to those sites to understand how your personal data is used and protected outside of Templafy.
